An Irish national from Kilkenny, aged 38, entered the United States on a tourism visa in 2009 but remained beyond the permitted 90 days. He was detained by ICE officers in Boston last September and transferred to a facility in El Paso, Texas. The Department of Homeland Security seeks his removal after nearly two decades of illegal residence. His attorney, Ms Ogor Winnie Okoye of Bos Legal Group, announced that the US Court of Appeals granted a stay of removal pending full case review. The stay preserves the court's ability to conduct meaningful judicial review and examine statutory and constitutional questions. The Department of Homeland Security's application to dismiss the appeal was denied. The case raises significant legal questions regarding immigration statute compliance and procedural safeguards required before removal orders.
