"On Monday, prosecutors charged 47-year-old Darin McFarlin, a longtime captain with nearly 25 years of service, with two counts of first-degree murder in the deaths of his live-in girlfriend Marissa Herzog, 29, and another person, according to a criminal complaint from the El Dorado County District Attorney's Office. The second victim is not named in the criminal complaint, but news reports and social media identified him as Herzog's son Josiah, who was reportedly in the second grade."
"Prosecutors allege that the killings were intentional, premeditated and carried out to stop both victims from testifying in a criminal matter. They also accused McFarlin of firing the gun that caused their deaths. McFarlin has additionally been charged with the attempted murder of another child, who has not been identified publicly. Prosecutors said he tried to kill the child using the firearm."
Darin McFarlin, a 47-year-old Cal Fire captain with nearly 25 years' service, was arrested after deputies responded to a reported shooting on Aug. 21 at a Cameron Park residence. Officers found a woman and a boy with gunshot wounds; the woman was pronounced dead at the scene and the boy later died at a hospital. Prosecutors charged McFarlin with two counts of first-degree murder, alleged to be intentional and premeditated to prevent testimony, plus attempted murder of another child, inflicting physical injury on Marissa Herzog, and causing severe mental suffering to a surviving child. First-degree murder with special circumstances carries death or life without parole.
