Hatcher was 37 when he was arrested by Toronto police after they found Kathleen Hatcher with significant injuries and without vital signs on a park trail near Old Mill TTC subway station."
"Nakatsuru's ruling also stated that it was indisputable Mr. Hatcher killed his mother, and the focus of his decision would be on whether Hatcher could be deemed criminally responsible. Hatcher's defence lawyer argued that he wasn't due to a long history of mental illness."
"Looking at the totality of the evidence even though I can readily conclude that Mr. Hatcher was mentally ill and unstable at the time of the homicide, I do not find it more likely than not that Mr. Hatcher was incapable of knowing that his actions were morally wrong, the judge's ruling said."
Colin Hatcher was convicted of second-degree murder for the 2021 death of his mother, Kathleen Hatcher, in an Etobicoke park. Justice Shaun Nakatsuru ruled that Hatcher, who suffered from schizophrenia, was guilty and did not meet the criteria for being deemed not criminally responsible. The judge acknowledged Hatcher's mental illness but concluded he was capable of understanding the moral implications of his actions. Hatcher will face sentencing in June.
