"The Police Accountability Board stated that BPD had improperly updated its use-of-force policy by implementing it without City Council approval, which the city's top attorney agreed with."
"Critics, including current and former PAB members, have labeled the proposed new policy as draconian, arguing it represents a full-scale attack on civilian oversight and gives officers too much leeway."
The Berkeley Police Department began loosening restrictions on the use of physical force, removing core values and easing reporting requirements. The Police Accountability Board objected, stating BPD cannot alter the policy without City Council approval. The current policy was finalized in July 2020 after George Floyd's murder. Critics argue the proposed changes grant excessive leeway to officers. BPD leaders issued the new policy to officers but paused its implementation pending a review by the City Attorney's Office in response to concerns raised by the Police Accountability Board.
