NCLD leadership pressed McMahon about proposals to move oversight of the Individuals with Disabilities Education Act (IDEA) from the Education Department to Health and Human Services. Project 2025 advocates eliminating the Education Department and transferring special education oversight to HHS. NCLD expressed alarm about uprooting the 50-year-old IDEA, noting HHS lacks the expertise to answer parents’ and school districts’ questions about complex special education law and services.
