The Office for Civil Rights has opened investigations into 14 K-12 school districts across multiple states, two California colleges, and the New York and Hawaii state education departments after receiving complaints alleging Title IX violations. The complaints claim that policies allowing students to participate in athletics based on gender identity, rather than biological sex, constitute sex discrimination. The Biden administration issued a 2022 interpretation of Title IX to protect gender identity; the president later signed an executive order rescinding that interpretation and OCR notified schools it would not enforce the trans-inclusive interpretation. OCR contends such policies jeopardize women’s safety and opportunities.
