Judge halts removal of Eritrean asylum seeker from UK to France under one in, one out'
"Mr Justice Sheldon halted the man's removal pending a final hearing of the case, after making findings that there may be difficulties for one in, one out returners accessing accommodation in France and that they were likely to face barriers accessing their entitlement to healthcare in the French system."
"The judge found there was a serious risk that the same will apply if he was to be returned to France. He added that the man would not be recognised by the French authorities as a victim of trafficking as the trafficking did not take place in France."
"The Eritrean asylum seeker, 31, who brought the legal challenge, is arguing that France does not provide adequate support for trafficking victims. He has been confirmed as a victim of trafficking by the UK authorities, after being detained and exploited by militia in Libya."
The UK's one in, one out scheme exchanges one asylum seeker arriving by small boat for another brought legally from abroad. As of March 5, 370 people were brought legally while 354 were returned to France. A 31-year-old Eritrean trafficking victim, confirmed by UK authorities and diagnosed with PTSD, challenged his forced return. The judge halted his removal, finding France provides inadequate accommodation and healthcare access for returnees and would not recognize him as a trafficking victim since his exploitation occurred in Libya. The man previously sought asylum in France without receiving support, raising serious concerns about his ability to access mental health treatment if returned.
