U.S. District Judge Pamela Chen dismissed some claims by PleasrDAO but allowed a misappropriation of trade secrets claim against Martin Shkreli to proceed. Chen stated that trade secrets encompass all forms of business information when reasonable secrecy measures and independent economic value exist. Chen found that the album’s value derived largely from its secret and exclusive nature. PleasrDAO purchased Once Upon a Time in Shaolin for roughly $4 million and alleged Shkreli retained and copied the album after being ordered to surrender it. PleasrDAO says Shkreli admitted making copies in livestreams and taunted a DAO member with 'LOL i have the mp3s you moron.'
