A federal appellate court has upheld an injunction blocking Florida's drag show ban, indicating it likely violates First Amendment rights concerning free speech. The law, passed by the Republican legislature, targets 'adult live performances' in the presence of children, implicitly aiming at drag shows. The court highlighted the vagueness of the law, suggesting it lacks clarity on what constitutes prohibited performances. The challenge stemmed from Hamburger Mary's restaurant, which hosts family-friendly drag events, asserting that enforcement would infringe on free speech rights.
The law is an "egregiously unconstitutional attempt to censor" free speech, the lawyer for the plaintiffs said.
By providing only vague guidance as to which performances it prohibits, the Act wields a shotgun when the First Amendment allows a scalpel at most," Judge Robin Rosenbaum wrote.
