Lani Chan and Nathan Bender of Big Spoon Sauce Co. encountered unexpected difficulties after filing for their trademark for "Big Spoon Sauce Co. Chili Crisp". Instead of the anticipated growth, they found themselves embroiled in a federal lawsuit by Big Spoon Roasters, a nut butter company claiming trademark infringement. Despite their legal counsel's assurance on brand distinctiveness, Big Spoon Roasters alleges consumer confusion due to the similarity in names and demands for significant legal actions against the small Bay Area business, including halting use of their name and compensation for damages.
"We had been in business for nearly a year, and we had begun to receive offers for investment and partnerships," Chan told SFGATE.
Big Spoon Roasters owners Mark and Megan Overbay have had the trademark for 'Big Spoon Roasters' since 2012, according to the United States Patent and Trademark Office.
The lawsuit alleges that the similar name has caused consumer confusion and 'irreparable injury' to the peanut butter company.
Now, Big Spoon Roasters is demanding that Chan and Bender stop using the name Big Spoon Sauce Co., destroy all labels and packaging.
