Disability Rights Are at Risk as 7 States Back Case Attacking Key Protections
Hundreds of disability advocates and allies gathered at Washington Square Park for the ADA35 NYC Protest, Rally, and March on July 26, 2025. A lawsuit pursued by Texas and six other states targets the Department of Health and Human Services and Secretary Robert F. Kennedy Jr., known as Texas v. Kennedy. Two state plaintiffs withdrew in May after concerns from the disability community, reducing remaining plaintiffs to seven from seventeen in an amended case. The remaining plaintiffs are Alaska, Florida, Kansas, Louisiana, Missouri, and Montana, while Indiana and South Dakota dropped out in the same month. The suit challenges Section 504 of the Rehabilitation Act of 1973, which bars disability discrimination in federal programs and federally funded programs. It also targets precedents and regulations collectively called Olmstead rules, which prohibit unnecessary segregation and support community-based services.
