The UK's largest truck manufacturer is being accused by the Road Haulage Association (RHA) of prolonging legal proceedings to obstruct justice for 11,000 hauliers claiming compensation for historical price fixing. This follows a 3bn fine imposed by the EU on major truck manufacturers for collusion on pricing. Since initiating the claim, the number of hauliers involved has decreased due to delays, exacerbated by the pandemic. The RHA claims to represent around 200,000 affected trucks and seeks compensation exceeding 6,000 per vehicle, alleging that manufacturers use legal strategies to hinder progress.
The manufacturers have been driving up costs with the purpose being to deny claimants money in their pockets that they deserve.
Over the seven years we have lost 6,000 [claimants] due to delays, many caused by the pandemic.
The RHA's legal claim is understood to revolve around about 200,000 trucks, of which 30% are thought to have been supplied by DAF.
Smith alleged that manufacturers had used legal tactics to frustrate the claim, including stating in court that they would settle, only to back away.
