The key question is whether she or her children are so entitled. He added that while Rayner would have declared her Hove flat as her only house, officials at HMRC would have until next spring to challenge that designation."

If HMRC determines the Hove flat was an additional dwelling, the higher stamp duty would be £70,000, creating an extra tax bill of about £40,000. Rayner had classified her Ashton-under-Lyne house as her main residence for council tax, avoiding a £2,000 bill on a London grace-and-favour apartment, and placed the constituency home into a trust before completion. Ownership for tax purposes can persist if she or her children are beneficiaries entitled to occupy the trust property. HMRC has until next spring to challenge the residence designation.
