Alan Dershowitz, a Harvard Law School Professor Emeritus, expressed that news organizations could seek legal remedies if they face impacts from government-sanctioned censorship. This statement followed revelations about the Global Disinformation Index, which received federal grants to combat disinformation abroad but reportedly compromised American media by censoring certain content, notably targeting Trump-related outlets. Dershowitz emphasized the importance of protecting the First Amendment and maintaining an open marketplace of ideas, which must not be compromised by foreign influence or misallocated federal funding.
I think there are legal remedies that can be made available if you can prove that you were damaged by misuse of federal funding to bring about censorship and harm to your advertising.
For the marketplace of ideas to remain open, and that's the essence of the First Amendment, it has to be equally open to all sides.
You can't have it [the First Amendment] with money allocated to foreign influences and use it domestically in the United States; that's a clear violation of the spirit of the First Amendment.
