The defendant is listed as a 23-year-old Dublin resident because he is serving a yearlong sentence for false imprisonment. Prosecutors filed the custodial possession charge on Dec. 2 and dismissed it at a Dec. 8 court appearance. The man told investigators he possessed the toothbrush for self-defense. A minute order says prosecutors made an oral motion to dismiss the case in the interests of justice. The jail sentence is eligible for up to a 50 percent reduction for good behavior.
