K'aun Green, an Oakland native and aspiring professional football player, received an $8 million settlement from the City of San Jose after being shot on March 27, 2022. Green disarmed a gunman during a brawl inside a La Victoria taqueria near San Jose State University while on a campus visit and was allegedly holding the handgun pointed upward as he backed out the restaurant entrance. Then-officer Mark McNamara shot Green four times. McNamara later was involved in a racist texting scandal denigrating Green to colleagues. Green filed a lawsuit that moved through federal courts asserting he was shot amid confusing police commands. The City Council approved the settlement unanimously, and the city attorney described the agreement as a negotiated resolution to avoid litigation risks.
