"I don't think Trump, in the end, will win this lawsuit because he would have to prove that The Wall Street Journal engaged not only in defamation, but malicious defamation. There has to be malice. And if The Wall Street Journal has a basis for making the statement, then they will prevail even if the statement was false and defamatory. So, it's a very hard barrier to overcome if you're a public figure."
"If I had to make a prediction, I would say no, Dershowitz responded. I would say that the lawyers for The Wall Street Journal are telling Murdoch that they really have no chance of losing this. So, I don't think we'll see a settlement. You know, it's possible that they'll put some change on the table to avoid having to go to court. But I'm not even sure this will survive a motion to dismiss."
The Wall Street Journal published an alleged drawing sent by Donald Trump as birthday wishes to Jeffrey Epstein in 2003. The doodle depicts a woman's torso enclosing a cryptic dialogue ending with the line, Happy Birthday and may every day be another wonderful secret. Epstein was later revealed to be a child sex trafficker. Trump denies authorship of the message and filed a $10 billion libel suit against the Journal and owner Rupert Murdoch. Alan Dershowitz said the case hinges on authenticity and that Trump must prove malicious defamation, a difficult burden for a public figure, making defeat likely and settlement unlikely.
