The judge issued a 52 page opinion finding that evidence at trial established armed soldiers were used to perform police functions in violation of the1878 Posse Comitatus Act, which bars military use against civilians. Trial evidence showed soldiers in protective armor and military vehicles setting up perimeters, traffic blockades, crowd control, and otherwise demonstrating a military presence. The judge noted troops also were sent to Washington, D.C., and threats were made to dispatch them to Oakland and San Francisco. A three-day trial was held on the issue and Newsom celebrated the ruling on X.
