However, on the first day of his second term, President Donald Trump issued an executive order that declared it was official policy of the administration that transgender, nonbinary, and intersex identities would not be recognized by the federal government."

Since Trump's return to office in January 2025, hundreds of federal surveys have removed sexual orientation and gender identity questions, according to a Williams Institute report. Gender identity measures accounted for the majority of removals across approximately 360 federal data collections. Most removals stemmed from Trump's executive order issued on his first day, which declared that transgender, nonbinary, and intersex identities would not be recognized by the federal government. Notably, 83% of these changes bypassed normal federal survey revision procedures and formal notice-and-comment processes, instead using non-substantive change requests to the Office of Management and Budget. The removals align with Project 2025 initiatives calling for eliminating sexual orientation and gender identity terminology from federal systems.
