The National Commission on Informatics and Liberty (CNIL) fined Google €325 million and Shein €150 million for setting advertising cookies on users' browsers without securing valid consent. Shein updated its systems and plans to appeal. The CNIL found that account creation nudged users toward personalized-ad cookies and did not clearly inform users that advertising cookies were required to access Google services, rendering consent invalid under the French Data Protection Act (Article 82). Google added a refusal option in October 2023 but informed consent remained lacking. Gmail ad placements in Promotions and Social tabs require explicit consent under the CPCE. Google must comply within six months or face €100,000 daily penalties. A U.S. jury found Google collected data after users opted out of Web & App Activity tracking.
