An arbitrator concluded that NewYork-Presbyterian's Morgan Stanley Children's Hospital violated safe-staffing provisions more than 600 times between Jan. 1, 2023, and May 31, 2024. Nurses at the pediatric ICU received an award totaling nearly $400,000 as a result of the arbitration. Union members documented staffing levels beginning in 2023 and established a perceived pattern of violations. Over 4,000 NYSNA members remain on strike in New York City, with safe staffing a central bargaining issue. NewYork-Presbyterian is appealing the award in federal court. The strike began after the nurses' contract expired on Dec. 31, 2025.
"While the financial remedies are nice, what we really want is more nurses and a contract that makes it harder for the hospital to avoid taking accountability, said Sophie Boland, a registered nurse at CHONY. That's why we're on strike."
"It shouldn't take years to get an acknowledgement of the conditions we've worked under when NewYork-Presbyterian could just do the right thing and safely staff the hospital, Boland said."
