David Contreras, accused of murdering his son Eric during an argument, has been granted the ability to live with his wife under house arrest. A judge ruled this after psychologist Dr. Neena Malik testified that Contreras was not a threat. Prosecutors opposed this, citing past violent incidents, including a prior discharge of a firearm at his son. Despite the arguments, the judge allowed Contreras to reunite with his wife, indicating that the family dynamics needed to be restored for healing.
"He's not a violent person. He's someone who is needed, frankly," Malik told the judge. "And she [Contreras's wife] needs her husband to heal. There is no indication of fear."
Miami-Dade Assistant State Attorney Rachel Morales-Gellis argued that the psychologist couldn't determine David Contreras wasn't violent because she hadn't viewed any arrest information.
Morales-Gellis stated, "Despite David Contreras having no prior arrests, there were instances of prior violence. There was another instance when he discharged a firearm at his son."
