Despite her school offering support, no arrangements were made promptly. After a medical diagnosis of autism, the Local Government Ombudsman (LGO) found the council at fault and ordered them to pay compensation. The LGO emphasized the council's responsibility to provide education to children absent for legitimate reasons, leading to an apology and acknowledgment of their failure to meet this obligation.
We have found the council at fault for a delay in providing access to suitable provision after receiving a medical letter. This caused distress, uncertainty and frustration for Dr X and her child.
B's situation highlights the responsibility councils have to act promptly when children are not attending school full-time, particularly when medical evidence is provided.
The Ombudsman ordered Lewisham Council to pay a symbolic compensation of 1,500 to Dr X, acknowledging the distress caused by the delays in securing suitable education.
