N.Y.P.D. Officer Who Fatally Shot Driver Should Be Fired, Judge Says

An administrative judge recommended the firing of NYC police lieutenant Jonathan Rivera for fatally shooting Allan Feliz during a seatbelt stop in 2019. Rivera pulled over Feliz, whose vehicle lacked a seatbelt, and after discovering warrants, attempted to detain him. When Feliz attempted to flee, Rivera used a Taser and then shot him, claiming self-defense. However, Deputy Commissioner Rosemarie Maldonado found his actions unjustified and stated he lacked credible reasons to feel threatened, leading to his assault conviction and now, a proposed dismissal from the force. The final decision rests with Commissioner Jessica S. Tisch.
"The killing was not justified because Lt. Rivera did not have any sound reason to believe the lives of his fellow officers were at risk," deputy police commissioner Rosemarie Maldonado stated.
"I did not believe him when he testified during an internal trial last November. He tailored his comments on the stand to play down his culpability."
"The case was brought by prosecutors for the Civilian Complaint Review Board, accusing Lt. Rivera of first-degree assault and obstructing justice."
