
Eligibility requires a marriage lasting at least 10 years, being unmarried or remarrying after age 60, and being at least 62. The ex must be eligible for benefits, and if they have not filed, divorce generally must have lasted at least two years. The benefit is only paid if the divorced spousal amount exceeds the benefit based on the claimant’s own earnings record because Social Security pays the higher amount rather than stacking checks. The maximum divorced spousal benefit equals 50% of the ex’s primary insurance amount, payable at the claimant’s full retirement age, which is 67 for people born in 1960 or later.
