Survivors of Toronto's Danforth shooting get green light on lawsuit against gun manufacturer | CBC News
Briefly

Survivors and relatives of the Greektown mass shooting can now pursue a class-action lawsuit against gun manufacturer Smith & Wesson after the Ontario Court of Appeal overturned a prior dismissal. In 2018, a gunman wielding a stolen .40 caliber handgun caused fatalities and injuries. The plaintiffs argued negligence due to the lack of authorized user technology in firearms. The Appeal Court clarified that the original judge set an unattainable standard for certification regarding potential success at trial, allowing survivors to seek corporate accountability and safer gun measures.
Handgun manufacturers like Smith & Wesson have long known they are making a product that can cause harm and should be held accountable for it.
The court noted that plaintiffs only needed to show that the negligence claim had a basis in evidence, not that it would succeed at trial.
