Under Trump's renewed administration, the U.S. has intensified its border externalization strategy, exacerbating conditions for migrants seeking asylum. Many who arrive in the U.S. are being sent to third countries like Costa Rica and Honduras, often without the opportunity to apply for asylum. This approach aims to circumvent legal constraints and has gained momentum under the influence of anti-immigrant officials. Legal experts highlight a shift in strategy, focusing on extrajudicial removals rather than attempting to modify immigration laws directly, thereby evading judicial oversight.
"One of the takeaways that they had from the many, many lawsuits that they faced is that it is easier to just get rid of asylum seekers and send them to those third countries extrajudicially, often in violation of existing law and judicial orders," said Azadeh Erfani, policy director at the National Immigrant Justice Center.
"While both parties have championed border externalization, it seems to be hitting an apex under a second Trump administration whose top anti-immigrant officials... are determined to barrel over anyone who gets in their way..."
