Judge Tanya Chutkan ruled against an immediate ban on Elon Musk's DOGE program, allowing it to proceed despite concerns raised by 14 states. The states' lawsuit argues that DOGE is not authorized by Congress and that Musk's actions threaten their programs. While acknowledging the legitimacy of the states' concerns about Musk's unchecked power, Chutkan found their request for an emergency restraining order to be overly broad and speculative, suggesting the possibility for future rulings in favor of the states.
In her decision, Judge Chutkan wrote that the states "legitimately call into question what appears to be the unchecked authority of an unelected individual and an entity that was not created by Congress and over which it has no oversight."
The Democratic attorneys general of the states that sued argued that DOGE's actions have harmed those states' ability to carry out educational and other programs.
