Judge Napolitano Explains On Newsmax Why Elon Musk And DOGE Lack the Authority' to Fire Federal Workers
Briefly

In a discussion with Newsmax anchor Sharla McBride, Judge Andrew Napolitano analyzed recent court rulings affecting the Trump administration. The focus was on the legal implications surrounding DOGE's authority to fire employees, particularly in relation to Elon Musk. Napolitano highlighted that since Musk was not confirmed by the Senate, he lacks the legal authority to make such personnel decisions. The analysis revealed complexities in the function of DOGE, suggesting it acts merely as a recommending body rather than an entity with executive powers, complicating its role in employment matters.
In the course of discovery where the sides exchange information back and forth with each other, DOGE said they did the firing, but Elon Musk lacks the authority as he wasn’t confirmed by the Senate.
If DOGE had said, we’re just recommending, we’re just gathering facts and recommending to the president, he’s doing the firing, of course, the president could fire at the USAID.
Dog needs to get its ducks in a row. It is just a recommending entity. It doesn’t have the authority to cut budgets or fire people.
The problem is who is doing the firing? If the president could fire people, then there’d be no issue at all.
