The U.S. Department of Education has provided guidance following the controversial Dear Colleague letter from February 14 that called for the end of race-conscious policies in higher education. The new nine-page FAQ document aims to help institutions comply with civil rights laws while interpreting the Supreme Court's decision in Students for Fair Admissions vs. Harvard. Reactions to this guidance vary, with some affirming it offers clarity, while critics argue it still undermines diversity, equity, and inclusion (DEI) efforts.
The Dear Colleague letter was a lot of rhetoric around DEI, including troubling language about how DEI is discriminatory and there wasn't really a defining of what DEI meant.
The FAQ is the least unhinged piece of work product that I've seen come out of the Trump administration regarding DEI initiatives, but it's been a low bar.
