Company executives, customs brokers and trade lawyers are awaiting a Supreme Court ruling on the legality of tariffs imposed under the International Emergency Economic Powers Act (IEEPA). Conservative and liberal justices expressed skepticism during November arguments about whether IEEPA authorized the tariffs. The tariffs have generated an estimated $133.5 billion in collections between Feb. 4 and Dec. 14, 2025, with totals approaching $150 billion. Trump is the first president to use IEEPA to impose tariffs, a law previously used for sanctions and asset freezes. Importers expect challenging fights over obtaining refunds and disputes over distribution if duties are returned.
