Apple dodges a second Apple Watch ban

AliveCor faced a legal defeat when the US Court of Appeals upheld a prior ruling that its EKG patents were not patentable, preventing a potential import ban on Apple Watches with EKG features. This case has been ongoing since 2021, when AliveCor first claimed patent infringement against Apple. Despite an initial ITC ruling in AliveCor's favor, the Patent Trial and Appeal Board subsequently deemed the patents invalid, a decision AliveCor failed to overturn on appeal. The company plans to explore further legal options to uphold its intellectual property rights.
We are deeply disappointed by the Court's decisions this morning and that the Court did not review the available secondary considerations, which the ITC found to be persuasive in their finding of validity.
